Three Major Oil Companies Settle in "Hot Fuel" Lawsuit - Source HDT

Three Major Oil Companies Settle in "Hot Fuel" Lawsuit

BP Products North America Inc., ConocoPhillips Co. and Shell Oil Products US have agreed to settle lawsuits accusing the oil companies of profiting from "hot fuel," gasoline or diesel fuel for which price has not been adjusted for temperature.

The term "hot fuel" refers to the expansion of gas or diesel fuel in the warmer months. Critics charge that when the fuel expands, it delivers less energy per gallon to the consumer, but the consumer is still charged the same price per gallon.

Oil companies argued that consumers benefitted in cold weather because fuel contracts and then contains more energy per gallon than usual. The companies also claimed that it would be too expensive to equip every retail pump with a temperature compensating device.

Sixty degrees is the century-old government standard for gas or diesel sold at the pumps. That is the temperature/volume used in the petrochemical industry to measure all petroleum liquids at the refinery and every point after the refinery, except at the retail pump, according to the Owner-Operator Independent Drivers Association, which has a website, turndownhotfuel.com, addressing the issue. OOIDA has been heavily involved in this issue for several years.

The warmer the fuel, the less measurable energy and fewer miles to the gallons a vehicle will get, says OOIDA. For example, if a vehicle averages 6 mpg, 200 gallons of 98-degree fuel is going to take that vehicle 36 fewer miles than 60-degree fuel.

In 2006, the Kansas City Star wrote a series of stories about the issue, estimating that hot fuel cost consumers $2.3 billion dollars a year. With today's fuel prices, that would be as much as $3.5 billion. After the Star's reports, class-action lawsuits sprouted up against dozens of companies, including oil giants and fuel-station chains.

These three big oil companies, however, are choosing to settle.

Although a preliminary settlement has been reached, details are not yet available, as the judge must approve details before they take effect.

The lawsuits are pursuing a solution that would retrofit pumps to adjust volume of fuel pumped based on temperature. The Kansas City Star reportsthat it's likely the companies won't be required to make these improvements, as "they have sold off most of their retail stations, although those stations still sell their brands." A more likely scenario is that the settlement will instruct the companies to facilitate the adoption of a hot-fuel fix.

Costco Wholesale Corp. agreed to settle in 2009, agreeing to change pumps in the hottest regions of the country.

Michelin Introduces Super-Regional Drive Tire, X One XDN2 Retread-Source Trucking Info

Michelin Introduces Super-Regional Drive Tire, X One XDN2 Retread

LOUISVILLE, KY -- In response to changing traffic patterns, and the emergence of regional operations as major segment of the trucking industry, Michelin Americas Truck Tires has launched a drive tire with on-highway fuel efficiency and protection from the bumps and scrapes of urban service.

The new Michelin X Multi Energy D drive tire is SmartWay-verified, and delivers enhanced fuel efficiency, optimized traction and long tread life to provide significant value and performance, the company says.

"Michelin continues to push the boundaries of balancing traditional performance characteristics, and the new X Multi Energy D tire is no exception," said Ted Becker, vice president of marketing for Michelin Americas Truck Tires. "This tire addresses the mileage, fuel, traction and scrub concerns of the regional trucking application, as well as what we see as an emerging super regional application -- trucks that operate approximately 100,000 miles per year, often within a 500-mile radius."

The Michelin X Multi Energy D tire delivers exceptional fuel economy and casing life by utilizing Michelin's Dual Energy Compound Tread. The top layer of tread rubber is balanced to deliver exceptional fuel efficiency while exhibiting the needed wear properties to resist tread scrub. The bottom layer of tread rubber maintains cool casing temperatures for low rolling resistance and extended casing life.

The tire employs Michelin's Matrix Siping technology to provide the interlocking tread action for excellent traction and even wear. The zigzag, grooved walls of the siping provide not only biting edges for traction, but also water and snow evacuation. The full-depth sipes deliver traction throughout the life of the tire's tread, and even the tire's shoulder area includes siping, further helping traction in adverse weather conditions without compromising tread life.

The X Multi Energy D tire's tread life is prolonged by the use of SipeSaver Technology. This teardrop shaped groove at the base of the shoulder sipes relieves stresses on the tread and prevents tearing. The wide footprint and wider working belts improve stability. The optimized footprint reduces the need for additional tread depth, allowing for significant mileage from the 24/32nds of original tread.

X One XDN2 Retread Now Available, with a Guarantee

To support the growing demand for wide-single tire products, Michelin is introducing the X One XDN2 Pre-Mold retread for fleets and owner-operators who want the fuel and weight savings of a wide-single tire with the traction of a lug-style tread. The retread is now available.

"X One wide single tires continue to offer huge benefits to the trucking industry," said Ted Becker, vice president of marketing, Michelin Americas Truck Tires. "The Michelin X One XDN2 retread combined with the weight and fuel savings of the Michelin X One casing offers even better grip and fuel efficiency."

The popular all-weather drive tread design now available in the X One XDN2 retread delivers superior traction and optimized mileage. The retread's Matrix Siping Technology provides exceptional traction on dry and slippery surfaces. Full-depth sipes supply excellent levels of traction, while the three-dimensional Matrix sipes lock together for the stability normally associated with solid tread blocks. The tread's wide, open shoulder grooves deliver additional traction balanced with tread life. The 375 mm retread is available with 27/32nds of tread depth.

The Michelin X One XDN2 Pre-Mold is only available for retreading on Michelin X One casings, and qualifies for the Michelin On Michelin Guarantee, which pledges 30 percent more mileage than competitor retreads and also guarantees a second X One trailer retread on a Michelin casing.

Higher Rates on Spot Market Affect Broker Use - Source Trucking Info

Higher Rates on Spot Market Affect Broker Use
Carriers are continuing to move away from the use of brokers, although not as much as in 2011, according to Transport Capital Partners.

In TCP's First Quarter 2012 Business Expectations Survey, carriers were asked if they have used more or less broker freight services as a share of their total revenue during the past three months. In both February and August of 2011, the percentage of carriers using more or less broker freight services was similar - around 12% to 15% for those using more and around 82% to 86% for those using less.

The number of carriers indicating they are using more broker freight services has doubled, from 15% in August 2011 to almost 33% in February of 2012. Likewise, 67% of carriers surveyed said that they were using less brokers.

"Load boards are indicating that spot freight rates in lanes are above long term rates and that the first quarter seasonal slowness may also have induced carriers to seek broker loads to keep drivers and equipment busy," says Richard Mikes, TCP partner.

More large carriers ($25 million or more in revenue) are using brokers than smaller carriers, but there is not a large difference - 34% of larger carriers versus 28% of smaller carriers.

According to Lana Batts, TCP partner: "While some carriers might use brokers to increase freight, TCP believes that most of these carriers are attracted to the spot market due to higher rates."

Despite the increase in the use of brokers, the amount of freight that makes up a carrier's total revenue is still relatively small, with 47% indicating it is less than 5%. Larger carriers seem to be taking more advantage of spot market rates than smaller carriers. "This trend, if continued, challenges thoughts by many observers that smaller carriers predominate in broker use," says Mikes.

"In a period of tightening capacity however, the slightest change in the spot market can adversely affect a shipper's ability to attract capacity. Historically, contract rates have been significantly lower than the spot market in times of tightening capacity," says Batts.

Survey Suggests 'Connected Fleet' is Becoming the Norm - Source Trucking Info

Survey Suggests 'Connected Fleet' is Becoming the Norm

GreenRoad's Fleet Leaders Survey shows that 57% of fleet leaders have "connected fleets" using Web-based fleet-management solutions. Twenty-eight percent of fleet leaders are actively using smartphones for fleet management today, and 8% are using iPads or tablet computers, the survey found.

Connected fleet technologies, defined as software-as-a-service solutions combined with smartphone and mobile technology enabled by high-speed connectivity, are growing at the expense of traditional standalone telematics solutions and PC-based software with no web access, according to GreenRoad. Only 41% of fleet leaders indicated they are still using PC-based software with no Web access, and only 12% are using proprietary handheld mobile devices.

The GreenRoad Fleet Leaders "Connected Fleet" Survey was conducted in February 2012 with 178 participants from a broad range of industries, fleet types and sizes. GreenRoad offers driver performance and safety management services using technology-based, personalized driver self-improvement techniques.

When asked about their future technology deployment plans, 31% of fleet leaders indicated they will be opting for web-based services, 25% plan to buy and deploy iPads or other table devices and 22% plan to purchase additional smartphones.

"The connected fleet has arrived," said Jim Heeger, chief executive of GreenRoad. "The data shows that web-based fleet management services are well on their way to displacing traditional, standalone telematic solutions."

"We can expect to see these trends accelerate as the technology continues to improve and fleet owners, operators and managers continue to experience the benefits of web-connected, mobile fleet management," continued Heeger.

As one respondent said, "it will become more and more necessary to manage fleet and driver operations while not [being] office-based."

Fleet Management Going Mobile

The survey also shows that mobile technology solutions are rapidly becoming a vital tool for fleet managers. Nearly one out of five (19%) of fleet managers are using smartphone or mobile apps to help manage fleets, and 37% of respondents expect to see an increase in the use of mobile apps for fleet management.

Fleet drivers are also increasingly using smartphones for fleet-related operations. Twenty-five percent (25%) of the fleet leaders surveyed said their drivers are using a job-specific smartphone or mobile app and 14% intend to increase driver smartphone and mobile app deployments. Overall, 51% of fleet leaders see their drivers as 'tech savvy' with the latest smartphone and mobile devices.

No Highway Bill, So Congress Extends Program for 90 Days -Source Trucking News

No Highway Bill, So Congress Extends Program for 90 Days
By Oliver B. Patton, Washington Editor

Congress yesterday passed a 90-day extension of the federal highway program, the ninth extension since the program formally expired in October 2009.

The House went first. After bitter partisan debate, it rejected pleas to clear the Senate's two-year, $109 billion highway bill and instead passed the extension.

The vote was 266 to 158, with 37 Democrats supporting the extension and 10 Republicans voting against it.

House leaders intend to use the three months to get agreement on the five-year, $260 billion bill that has been stalled by objections from some conservative Republicans as well as most Democrats.

The Republicans don't like the spending levels in the bill, which would use funds raised from new oil and gas drilling to supplement the Highway Trust Fund. Democrats object to the drilling, among other provisions.

In the argument leading up to the vote, Rep. Peter DeFazio, D-Ore., referred to the conservative Republicans who object to the bill as "bozos." Rep. John Mica, R-Fla., called for the House physician to treat Democratic members who were suffering from "amnesia" because they seemed not to remember passing extensions when they were the majority.

The Senate had been pushing for its measure, which cleared earlier this month on a lopsided bipartisan vote - a rarity these days.

However, the current extension is due to end midnight Saturday, and with no bill, the highway program and the federal government's ability to collect the fuel taxes that fund highway construction and maintenance would have come to a screeching halt.

So the Senate reluctantly passed the House extension.

This sets up a rematch by the end of June. If the House is able to come to terms on a bill it can pass, with or without Democratic support, its measure will then have to be reconciled with the Senate bill.

Although the two bills are similar in the way they approach important program reforms at the Department of Transportation, the conflicting terms and funding mechanisms will present serious obstacles.

Meanwhile, state transportation departments will have to keep holding their breath for a long-term highway program. Uncertainty has caused a number of states to delay billions of dollars in highway projects, said John Horsley, executive director of the American Association of State Highway and Transportation Officials.

"The clock has been reset, and we are optimistic that the House and Senate will use the time available to settle on a new, long-term reauthorization," Horsley said in a statement.
